Do not terminate the services of 11 teachers who are seeking pay revision - Delhi High Court directs Gurusharan Convent School

On 23.11.2021, the Hon’ble Delhi High Court directed the Gurusharan Convent School, GH-9 Block, Near Telephone Exchange, PaschimVihar, Delhi-110087, not to terminate the services of 11 teachers, who had filed a writ petition [W.P.  (C) No. 11619/2021, entitled ‘Mini Monterio & Ors. Vs. Gurusharan Convent School & Ors.’] seeking revision of their salary as per 7th CPC.

 

The teachers of all private schools, including the minority schools, in Delhi, are entitled to receive salary equal, or more, than the salary paid to their counterparts in the Government run schools. The said benefit was, however, denied to the 14 teachers by the Gurusharan Convent School. Above all, the salary of these 14 teachers was drastically reduced during the covid period. Being aggrieved, on 06.10.2021, the teachers filed a writ petition before the Hon’ble Delhi High Court seeking revision of their salary as per 7th CPC.

 

In order to victimize the teachers, the school terminated the services of 3 teachers, who were petitioners in the aforesaid writ petition, immediately after filing of the writ petition. The remaining 11 teachers preferred an application [C.M. No. 41443/2021] thereby seeking stay of their apprehended termination from service. Vide Order dated 23.11.2021, Hon’ble Mr. Justice V. Kameswar Rao, Delhi High Court, directed the school to not to terminate the services of the 11 teachers.

 

The writ petition is now listed for hearing on 22.03.2022.
