Do not terminate the services of 11 teachers who are seeking pay revision - Delhi High Court directs Gurusharan Convent School

On 23.11.2021, the Hon’ble Delhi High Court directed the Gurusharan Convent School, GH-9 Block, Near Telephone Exchange, PaschimVihar, Delhi-110087, not to terminate the services of 11 teachers, who had filed a writ petition [W.P.  (C) No. 11619/2021, entitled ‘Mini Monterio & Ors. Vs. Gurusharan Convent School & Ors.’] seeking revision of their salary as per 7th CPC.

 

The teachers of all private schools, including the minority schools, in Delhi, are entitled to receive salary equal, or more, than the salary paid to their counterparts in the Government run schools. The said benefit was, however, denied to the 14 teachers by the Gurusharan Convent School. Above all, the salary of these 14 teachers was drastically reduced during the covid period. Being aggrieved, on 06.10.2021, the teachers filed a writ petition before the Hon’ble Delhi High Court seeking revision of their salary as per 7th CPC.

 

In order to victimize the teachers, the school terminated the services of 3 teachers, who were petitioners in the aforesaid writ petition, immediately after filing of the writ petition. The remaining 11 teachers preferred an application [C.M. No. 41443/2021] thereby seeking stay of their apprehended termination from service. Vide Order dated 23.11.2021, Hon’ble Mr. Justice V. Kameswar Rao, Delhi High Court, directed the school to not to terminate the services of the 11 teachers.

 

The writ petition is now listed for hearing on 22.03.2022.

B.Ed. (Special Education-Distance Education) students of Uttarakhand Open University denied registration by the Rehabilitation Council of India (RCI) – Delhi High Court issued notice to the RCI as well as the University

On 22.11.2021, in “Amit Kumar & Ors. Vs. Rehabilitation Council of India & Ors.”, W.P. (C) No. 13120/2021, Hon’ble Delhi High Court issued notice to the RCI as well as the University on account of denying registration to 6 B.Ed. (Special Education) students.

 

The writ petition was filed by 6 B.Ed. students. The petitioners/students have passed B.Ed. (Special Education-Distance Education) from Uttarakhand Open University in the year 2018. In order to meet the eligibility for the post of Special Education Teacher, as well as in conformity with the RCI Act, 1992, B.Ed. (Special Education) students are required to get themselves registered with the RCI. The petitioners/students duly applied for registration but RCI has returned the applications on the ground that the batch of the petitioners/students was not approved by the RCI.

 

RCI, vide letter dated 19.03.2021 to the Ministry of Education, Govt. of India, has stated that out of 24 study centres only 2 study centres of the University fulfil the prescribed eligibility conditions. RCI has also stated that 86 students, who passed out from the above 2 study centres, have been registered by the RCI. On the recommendation of the Education Minister, Govt. of India, the RCI has also constituted a Technical Committee for examining the matter.

 

On the other hand, the University has informed the petitioners/students that the issue of registration has been resolved with the RCI and very soon all the students will be called for registration by the RCI.

 

The next date of hearing in the matter is 28.01.2022.
