Delhi
High Court on 16.04.2024 dismissed a writ petition filed by Central Public
Works Department (CPWD) challenging a Recovery Certificate issued by Labour
Commissioner in favour of a workman. While dismissing the writ petition, the
Delhi High Court, inter alia, held as under: -

Daily
wage employees of CPWD are entitled to wages equal to that of a regular
employee.
2.
In
case of an Industrial Tribunal’s Award directing reinstatement in service with
40% back wages, a workman is entitled to 40% back wages from the date of
termination till the date of Award, and 100% wages from the date of Award till the
date of actual reinstatement in service.
3.
To
invoke the writ jurisdiction of High Court, it must be proved that the Court
below has exceeded or usurped its jurisdiction, or acted illegally, or in
contravention to any law, or there is an error on the face of record.
