Gratuity Authority directed the school to immediately release the gratuity along with interest @ 10% thereupon on account of delay

Non-payment of gratuity to a confirmed Post Graduate Teacher (PGT) – 27 years’ service – Private school did not pay gratuity on the ground that a writ petition (pertaining to salary as per 7th CPC) is pending before the Hon’ble Delhi High Court and payment can only be made after decision of the said case – Gratuity Authority held that pendency of a writ petition before the High Court is not a justified reason for withholding gratuity – Gratuity Authority directed the school to immediately release the gratuity along with interest @ 10% thereupon on account of delay.

Public Interest Litigation (PIL) – prayer for a direction to the Delhi Government to create an official website of the Delhi School Tribunal (DST) so that daily as well as final orders could be accessed by the Advocates as well as the litigants. Delhi High Court issued notice and directed the GNCTD to file a status report. Directive part of the Order dated 15.03.2022 is as under: -

 The limited grievance raised by the petitioner who appears in person is that the Delhi School Tribunal does not have an official website of its own for uploading the daily/final orders, case status, notifications, circulars, etc. In our view, considering the fact that the Delhi School Tribunal hears grievances relating to teachers and other employees of the school in Delhi and therefore, has to undertake public hearing and public dealing, it is imperative that it should have its own official website in this new age. Let a status report be filed before the next date. List on 21st April, 2022.
