Non-payment of gratuity to a confirmed Post
Graduate Teacher (PGT) – 27 years’ service – Private school did not pay
gratuity on the ground that a writ petition (pertaining to salary as per 7th
CPC) is pending before the Hon’ble Delhi High Court and payment can only be
made after decision of the said case – Gratuity Authority held that pendency of
a writ petition before the High Court is not a justified reason for withholding
gratuity – Gratuity Authority directed the school to immediately release the
gratuity along with interest @ 10% thereupon on account of delay.
