High Court directs payment of full salary with interest to 23 teachers of
Siddharth International Public School
The Hon’ble
Delhi High Court on 03.09.2021, in Shashi Kiran & Ors. Vs. Siddharth
International Public School & Ors., WP (C) No. 2734/2021, directed the
Siddharth International Public School to pay full salary with 7% interest upon
the arrears of salary to the 23 teachers.
On 23.03.2020,
nationwide lockdown was declared by the Central Government on account of
Covid-19 Pandemic. However, the teachers continued working by taking online
classes of the students. The school w.e.f. 01.04.2020 reduced the monthly
salary of the teachers to 50%. Being aggrieved, the teachers made a joint
representation dated 29.12.2020 to the school thereby requesting the school to pay
them the full salary. The school, however, became vindictive and issued four Memos/Show
Cause Notices to the teachers in the month of January-February, 2021 on account
of demanding their full salary. The teachers challenged the Memos/Show Cause
Notices before the Hon’ble Delhi High Court and also demanded the payment of
full salary with appropriate interest.
Hon’ble Mr.
Justice V. Kameswar Rao, Delhi High Court, in WP (C) 2734/2021, directed the
school to pay full salary to the 23 teachers and pay the arrears within a
period of 08 weeks along with interest @ 7% per annum. The Memos/Show Cause
Notices, which were issued to the teachers on account of demanding their full
salary, were withdrawn by the school during the arguments before the Hon’ble
Delhi High Court. The Hon’ble Delhi High Court, accordingly, directed that no
part of the Memos/Show Cause Notices, which pertains to demand of full salary,
shall be given effect by the school.
